MVNM PRIVACY POLICY Scope (“MVNM”) is a service provided by MVNM, Inc. We acknowledge and respect your personal privacy. Your Information on MVNM Once you have created an account with MVNM, you will be required to choose a user name. This user name will be displayed throughout Ethereal and therefore provided to the public. Unless you associate your user name with your personal information, other users will not be able to personally identify your activities on MVNM. When visiting from a public or shared computer, certain information about you, such as your user name, may also be visible to others who may use that computer after your use. It is your responsibility to ensure private information is removed from the public or shared computer should you choose to use one. Access and Change of Personal Data You can access and change most of your personal information by logging on to MVNM at any time. You are required to promptly update your personal information if changes occur or information is inaccurate. Closing Your Account Upon closing your account, MVNM will remove your personal information from view as soon as reasonably possible, based on your account activity and in accordance with applicable law. We do retain personal information from closed accounts to comply with law, prevent fraud, collect any fees owed, resolve disputes, troubleshoot problems, assist with any investigation, enforce our Terms and Conditions, and take any other action otherwise permitted by law. Use of Cookies MVNM uses so-called “cookies,” which are files that are stored on your computer that can be retrieved to assist in customizing your experience with the online service. Protection from Web Crawlers or Spam MVNM assures you that we will use your e-mail address with your express consent only for the purposes stated in the User Agreement. We will not rent or sell your e-mail address to third parties, and we will prevent your e-mail address from being recorded by “web spiders” to the best of our ability. MVNM does not knowingly collect or solicit personally identifiable information from or about children under the age of thirteen (13) consistent with and exceeding the requirements of the Children’s Online Privacy Protection Act. If we discover or are otherwise notified that we have received any such information from a child in violation of this policy, we will delete that information. As described above, we allow certain companies to place tracking technologies on our sites, which allow those companies to receive information about your activity on our sites that is associated with your browser or device. Based on our understanding of the CCPA, MVNM believes this is not a “sale” of personal information and that we have not sold the personal information of CA users, including minors under 16 years of age, within the preceding 12 months, nor will we do so going forward. Right to Non-Discrimination for Exercising Privacy Rights MVNM will not discriminate against CA users for exercising their rights under the CCPA. Please note that MVNM may deny or fulfill a request only in part, based on our legal rights and obligations. Please also note that, for purposes of these rights, personal information does not include information about job applicants, employees and other of our personnel or information about employees and other representatives of third-party entities we may interact with. When we receive a request, we will verify the identity of the requestor and undertake to respond within the periods set by California law. If a CA user has a password-protected account with MVNM, we will verify their identity through MVNM’s existing authentication practices and will require him or her to re-authenticate themselves before disclosing or deleting the user’s data. If a CA user does not have a password-protected account, we will take reasonable steps to verify their identity in accordance with the CCPA prior to responding any request. The verification steps may vary depending on the sensitivity of the personal information. If we cannot verify a requestor’s identity using these methods, we may use an appropriate third-party verification service. Designating an Authorized Agent to Submit Privacy Requests CA users may use an authorized agent to submit a Request to Know or a Request to Delete. An authorized agent is a person or entity registered with the California Secretary of State that a CA user has authorized to act on his or her behalf. If you choose to submit a privacy request to MVNM through an authorized agent, we may require that you provide the agent with written permission to do so and that the agent verify their own identity with MVNM. If your privacy request is submitted by an agent without proof that they have been authorized by you to act on your behalf, we may deny the request. “Shine the Light” Law A CA user who has provided personal information to a business with whom he has established a business relationship for personal, family, or household purposes is entitled to request information about whether the business has disclosed personal information to any third parties for the third parties’ direct marketing purposes.
